1. Introduction
FeatsClub Inc. ("FeatsClub" or "We") respect your privacy and are committed to protecting it through our compliance with this Privacy Statement.
This Privacy Statement describes the types of Personal Information we may collect from you or that you may provide when you use our application (the "App") and our practices for collecting, using, maintaining, protecting, and disclosing that information.
"Personal Information" as used in this Statement means information that identifies, relates to, describes, or can reasonably be linked, directly or indirectly, to a specific natural person. It does not include information that is considered anonymous, de-identified, or aggregated by applicable law.
This Privacy Statement applies to the information we collect:
On the App
In email, text, and other electronic messages between you and FeatsClub.
When you interact with our advertising on third-party Apps and services, if those applications or advertising include links to this Privacy Statement.
Please read this Privacy Statement carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our App. By accessing or using the App, you agree to this Privacy Statement. This Privacy Statement may change from time to time. Your continued use of the App after we make changes is deemed to be acceptance of those changes, so please check the Privacy Statement periodically for updates.
FeatsClub operates a public consumer database that most web and mobile-app users interact with directly. Some educational institutions also use FeatsClub under a school-tenant agreement, with their own logically separate database.
For users located in India, Personal Information is processed by FeatsClub India Private Limited, our Indian subsidiary, acting jointly with FeatsClub Inc. as data fiduciary under the Digital Personal Data Protection Act, 2023 ("DPDP Act"). References to "FeatsClub," "we," "us," or "our" in this Statement, when applied to users in India, include FeatsClub India Private Limited.
The section titled "Rights Under The Family Education Rights and Privacy Act (“FERPA”) applicable to School Tenant Deployments" describes additional protections that apply in school-tenant deployments. Where that section conflicts with another part of this Statement, the "Rights Under The Family Education Rights and Privacy Act (FERPA)" section controls as to education records held on a School’s behalf.
2. Children Under the Age of 13
This section reflects the requirements of the U.S. Children’s Online Privacy Protection Act (COPPA), which applies to children under 13.
The Children’s Online Privacy Protection Act of 1998 and its rules (collectively, "COPPA") require us to inform parents and legal guardians (as used in this section, "parents") about our practices for collecting, using, and disclosing personal information from children under the age of 13 ("children"). It also requires us to obtain verifiable consent from a child’s parent for certain collection, use, and disclosure of the child’s personal information.
This section notifies parents of:
The types of information we may collect from children.
How we use the information we collect.
Our practices for disclosing that information.
Our practices for notifying and obtaining parents’ consent when we collect personal information from children, including how a parent may revoke consent.
All operators that collect or maintain information from children through this FEATSCLUB App.
This section only applies to children under the age of 13 and supplements the other provisions of this privacy policy.
3. Information We Collect from Children
FeatsClub helps children build a portfolio of extracurricular activities, participation, and achievements from an early age. Before a child turns 13 (or reaches the applicable age of majority), a parent or guardian is the sole account holder and controls this portfolio and all interactions on the child's behalf, with the intention of transferring control of the portfolio to the child when appropriate.
FeatsClub does not knowingly issue or maintain a separate login or session for a child, and does not knowingly collect information directly from a child through independent use of the App.
We only collect as much information about a child as is reasonably necessary for the child to participate in an activity, and we do not condition participation on the disclosure of more personal information than is reasonably necessary.
4. Information We Collect Directly
When a parent or guardian creates a profile for their child under their own account, they provide the following information on their child's behalf, so that competition results, attendance records, and certificates are correctly attributed to the child by name. This information relates to the child, but is entered and controlled by the parent, and is intended to transfer to the child's own control if and when the child reaches the age of majority and an account transfer occurs:
Name
Gender
Photo
Birthdate
A short bio or tagline, and related media (such as photos or videos), at the parent's discretion
Extracurricular interests, activities, skills, and achievements
Associated school clubs or community service organizations
Social handle links relating to the child's activities
Event participation and attendance
Interactions associated with the child's profile, such as posts, chats, and purchases made by the parent on the child's behalf
The parent's own email address, phone number, and login credentials are associated with the parent's account, not with the child's profile. We specify whether information is required or optional when we request it.
The App may offer chat, posting, and other interactive features ("Social Features") to account holders. Because a child does not hold an independent account or session, any use of Social Features on the child’s behalf occurs through the parent’s own account. We encourage parents to use these features responsibly and to be mindful of any information they choose to share.
5. Automatic Information Collection and Tracking
We use technology to automatically collect certain information as a parent's account accesses and navigates through the App, including:
One or more persistent identifiers associated with the parent's device, used to recognize the device over time and across different websites and online services.
When a parent checks their child in at an event using the App, the geolocation of the parent's device at the time of check-in, in order to confirm the child's attendance at the event.
We may combine non-personal information we collect through these technologies with personal information we collect online.
For information about our automatic information collection practices, including how you can opt out of certain information collection, see the "Information We Collect Through Automatic Data Collection Technologies," "Choices About How We Use and Disclose Your Information," and "California & Other U.S. State Privacy Rights" sections of our general Privacy Policy.
6. How We Use Your Child’s Information
We use the information a parent provides about their child to:
Register the child’s profile with the Service;
Communicate with the parent about activities or features of the App that may be of interest to the child;
Track the child’s participation and performance in competitions, games, or other activities, and correctly attribute results, attendance, and certificates to the child by name;
Provide services the parent requests on the child’s behalf;
Market new academies or coaches, volunteering opportunities, or part-time roles that may be of interest, communicated to the parent.
We use the information we collect automatically through technology (see Automatic Information Collection and Tracking) and other non-personal information we collect to improve our App and to deliver a better and more personalized experience by enabling us to:
Estimate our audience size and usage patterns.
Store information about preferences, allowing us to customize the content according to individual interests.
Speed up your searches.
We use event check-in geolocation information, described above, to confirm event attendance and to provide relevant information on local academies, coaches, events, and venues.
7. Our Practices for Disclosing Children’s Information
We do not share, sell, rent, or transfer children’s personal information other than as described in this section.
We may disclose aggregated information about many of our users and information that does not identify any individual or device. In addition, we may disclose children’s personal information:
To third parties we use to support the internal operations of our App and who are bound by contractual or other obligations to use the information only for such purpose and to keep the information confidential.
If we are required to do so by law or legal process, such as to comply with any court order or subpoena or to respond to any government or regulatory request.
If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of FeatsClub and our customers or others, including to: protect the safety of a child; protect the safety and security of the App; or enable us to take precautions against liability.
To law enforcement agencies or for an investigation related to public safety.
In addition, if we are involved in a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of FeatsClub’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding or event, we may transfer the personal information we have collected or maintain to the buyer or other successor.
Where children participate in FeatsClub through a School tenant, disclosure of their education records is governed by the section titled "Rights Under The Family Education Rights and Privacy Act (FERPA)" and by the School’s agreement with FeatsClub, in addition to the parental controls described above.
Commitment to Child Safety
FeatsClub is dedicated to providing a safe environment for all users, especially children. We have a zero-tolerance policy towards child sexual abuse and exploitation (CSAE) and are committed to preventing the presence and distribution of child sexual abuse material (CSAM) on our platform.
Compliance with Global Child Safety Laws
In addition to COPPA, FeatsClub complies with all applicable child safety laws and regulations, including the UK’s Age Appropriate Design Code and the EU’s General Data Protection Regulation (GDPR) concerning children’s data.
8. Social Features
The App offers social features, including chat and posting on message boards that enable children to communicate with others through the App. We do not control the types of information your child can send or post through them. We encourage parents to educate their children about safety online and to carefully monitor their children’s use of social features to ensure they do not disclose their personal information through them.
9. Accessing and Correcting Your Child’s Personal Information
At any time, you may review the child’s personal information maintained by us, require us to correct or delete the personal information, and/or refuse to permit us from further collecting or using the child’s information.
You can review, change, or delete your child’s personal information by:
Logging into your child’s account and using the Account Management section under Settings to delete the account directly, the same way any user can delete their FeatsClub account.
Sending us an email at appsupport@featsclub.com. To protect your privacy and security, we may require you to take certain steps or provide additional information to verify your identity before we provide any information or make corrections.
For any child safety concerns or inquiries, please contact our operations team that monitor content at appsupport@featsclub.com.
Data Retention
We retain a child’s personal information for as long as the child’s account remains active, since this is necessary for us to continue providing the App and the services described above. If a parent or guardian requests that we delete the child’s account, we delete the associated personal information immediately.
We do not currently automatically delete personal information from accounts that become inactive; a parent or guardian may delete an inactive account at any time via Settings > Account Management, or by emailing us as described above. We expect to introduce automatic deletion timeframes for inactive accounts as our data retention practices mature, and will update this Statement accordingly.
In-App Reporting Mechanism
We have implemented an in-app feature that allows users to report any inappropriate content or behavior. This tool enables users to flag content that may be harmful or violates our community guidelines, ensuring prompt review and action by our moderation team.
Procedures for Handling CSAM
Upon identification of any CSAM, we will:
Immediately remove the content from our platform.
Report the material to the appropriate law enforcement agencies and the National Center for Missing & Exploited Children (NCMEC).
Cooperate fully with authorities during any investigations.
10. Operators That Collect or Maintain Information from Children
A list of all operators that may collect or maintain personal information from children through the App is available here: Stripe (www.stripe.com), and Cashfree Payments (www.cashfree.com), used for payment processing for transactions in India.
Please direct your inquiries about any operator’s privacy practices and use of children’s information to the operator at its contact information provided.
11. Rights Under The Family Education Rights and Privacy Act (FERPA) applicable to School Tenant Deployments
This section applies only when FeatsClub is provided through a school, college, or other educational institution under a school-tenant agreement, and you access FeatsClub through a school-issued account or school-branded surface.
It does not apply to the public FeatsClub platform, which most users (web and mobile app) interact with directly.
When a school, college, or other educational institution (the "School") contracts with FeatsClub to provide services to its students, certain information we process on the School’s behalf may constitute "education records" under the Family Educational Rights and Privacy Act, 20 U.S.C. § 1232g, and its implementing regulations at 34 CFR Part 99 (collectively, "FERPA").
In these deployments, FeatsClub acts as a "school official with a legitimate educational interest" under 34 CFR § 99.31(a)(1)(i)(B), and operates under the direct control of the School with respect to the use and maintenance of those records.
